Welcome to Town and Sea!

These terms of use outline the rules and regulations for the use of Town and Sea LLC’s website, located at www.townandsea.com, hereinafter referred to as “Town and Sea”. By accessing this website, we assume you accept these terms of use. Do not continue to use Town and Sea if you do not agree to all of the terms of use stated on this page.

Site Users

The site is available to users who are 18 years and older. By completing and submitting your registration on the site, you have opted-in to receive email communication from us. As a registered user, you agree to provide accurate information about yourself on the site’s registration forms. As a registered user, you agree to maintain valid credit card information within your Account Dashboard so long as you maintain an account with Town and Sea. Purchases, offers, and bids placed on the Town and Sea website are a binding contract, and you are responsible for paying all amounts due to Town and Sea if you are a winning buyer or bidder. Please do not bid if you are unable to pay the winning bid amount along with the buyer’s premium, credit card fees, and applicable sales taxes. By placing a bid, you also acknowledge that you will be able to pick up the item either through communication with our logistics coordinator if purchased on The Reserve or the designated pickup date if you are to be the winning bidder, whether in person or by shipper.

Item Representations

All items are sold in as-is condition. All listings are meant as a descriptive guide only. Town and Sea will do its best to photograph and portray any damage to items listed on the site in an accurate manner. The absence of descriptions or conditions must not be taken to imply that a Lot or an item for sale on Town and Sea is in perfect condition. Most items listed on Town and Sea are used, vintage, or antique items with signs of wear. Additional condition reports may be available upon request. Town and Sea is not responsible for typographical errors on the site, and all measurements are to be considered approximate. Town and Sea will not guarantee the authenticity of any signature unless so stated at the time of auction. No in-person previews are available for our consignment or auction items.

Terms of Payment

Town and Sea requires a valid credit card to be added to a registered buyer’s Account Dashboard to place an order, an offer, or a bid on the site. By providing a credit card, you authorize Town and Sea to charge your credit card for all consignment and auction invoices, including buyer’s premiums, credit card fees, and applicable sales taxes. All site users must agree to this payment format in order to continue using the site and acknowledge that you will maintain valid credit card information within your Account Dashboard as long as you maintain an account with Town and Sea.

Buyer’s Premium

A buyer’s premium of 15% will be added to the hammer price (winning bid) in all auctions held on Town and Sea.

Sales Tax and Credit Card Fees

All sales are subject to appropriate sales tax laws. Tax-exempt buyers must provide the appropriate state sales tax exemption certificate prior to the end of the sale. Upon receipt of such information, your future purchases will not be taxed. All tax resale forms must be emailed to info@townandsea.com in order to be reviewed by a Town and Sea admin. Your name and address for your account must be the same as your resale certificate in order for the tax exemption to be accepted.

Credit Card Information

By providing your credit card information to Town and Sea, you authorize Town and Sea to auto debit/charge your credit or debit card on file for the purchase amount of any consignment purchases as well as any winning bids, including the buyer’s premium, credit card fees, and applicable sales tax. All sales are final. Town and Sea is not responsible for internet bidding errors or errors with any electronic device. In the event that you fail to pick up or pay for your items, your item will be considered forfeited, and no refunds will be issued. You also agree to authorize Town & Sea to auto-debit/charge your credit card when making an offer on a consignment item if the consignor accepts the offer along with any applicable sales tax.

Refunds

All sales on Town and Sea are final. Refunds will only be issued if an item is lost prior to the pickup, removed from the auction or consignment by the seller, or if damage occurs after the piece was photographed and prior to the pickup. We do our best to represent items accurately and portray their condition; however, if an item is considerably damaged after it has been listed for sale, Town and Sea will issue either a full or partial refund to the winning bidder or buyer. All damages and refunds must be agreed to at the time of the pickup or delivery. Once an item has been released at the pickup or a third-party delivery, the sale is considered complete, and no further refunds will be considered. Town and Sea is not responsible for any damage occurring after an item has been released at the pickup or for delivery.  

Item Pickup

Winning bidders must pick up their items on the designated pickup date advertised during the auction. The city and state of the pickup location will be advertised on the sale and product page during the auction and the pickup address will be emailed to the winning bidders upon the close of the auction. Winning bidders must come with their own packing materials, manpower, and appropriate vehicle. For shipper recommendations, please email logistics@townandsea.com. All shippers will be required to pick up the item(s) on the designated pickup date advertised during the auction. Please email us with the shipper’s name and telephone number ahead of the pickup date. 

For pieces purchased on consignment, Town & Sea requires that any items picked up at a consignor’s home be picked up by an insured white-glove delivery company. Please email us at logistics@townandsea.com for a list of recommended shippers. 

Forfeiture of Items

Any items not paid for in accordance with the Site’s Terms of Use will be considered forfeited. Any items not picked up in accordance with the designated auction pickup dates and times will be considered forfeited. If an item does not fit into a winning bidder’s vehicle on the day of the pickup, that item will be considered forfeited if the winning bidder is unable to transport the piece within the time window of the pickup date. Town and Sea has the ability to re-offer forfeited items for sale.

For consignment purchases, Town & Sea requires that the items be collected within two weeks of purchase. 

Intellectual Property

Unless otherwise stated, Town and Sea LLC and/or its licensors own the intellectual property rights for all material on Town and Sea. You must not republish material, sell, rent, sub-license, reproduce, duplicate, copy, or redistribute content from Town and Sea.

Town and Sea Bidding Terms

If I am the winning bidder of the lot, I agree to pay the hammer price plus the 15% buyer’s premium and all applicable sales tax.

If I do not collect this item during the designed pickup window, I agree to forfeit my purchase without a refund.

What is a Maximum Bid?

After placing a maximum bid, our software will automatically bid on your behalf in $1 increments above any competing bids that are below your maximum bid value. It is a strategic way to ensure you will not be outbid in the final moments within your predetermined bid range.
