Welcome to Town and Sea!
These Terms of Use outline the rules and regulations for using the Town and Sea LLC website, located at www.townandsea.com, hereinafter referred to as “Town and Sea.” By accessing this website, you agree to these Terms of Use. If you do not agree to all terms stated here, please do not use the site.
Site Users
Town and Sea is available to users 18 years of age or older. By completing and submitting your registration, you opt in to receive email communications from us. As a registered user, you agree to provide accurate information and to maintain a valid credit card on file within your Account Dashboard while your account is active.
Purchases, offers, and bids placed on the Town and Sea website, or through Town and Sea auctions hosted on LiveAuctioneers, are binding contracts. If you are a winning buyer or bidder, you are responsible for payment in full, including winning bid amounts, buyer’s premiums, credit card fees, and applicable sales taxes. Please do not bid or make offers if you are unable to meet these payment requirements.
Town and Sea reserves the right to block or revoke site access and privileges to any user who violates these Terms of Use or engages in inappropriate or abusive conduct toward Town and Sea employees, contractors, or representatives.
Item Representations
All items are sold as is. Listings are intended as descriptive guides. Town and Sea will make every effort to photograph and note visible damage accurately; however, the absence of a condition statement does not imply an item is free from flaws.
Most items listed on Town and Sea are used, vintage, or antique, and will show signs of wear. Additional condition reports are available upon request.
Town and Sea is not responsible for typographical errors, and all measurements should be considered approximate. We do not guarantee the authenticity of any signature unless explicitly stated.
Terms of Payment
A valid credit card must be added to your Account Dashboard to place an order, offer, or bid. By providing this information, you authorize Town and Sea and LiveAuctioneers to charge your card for any purchases or winning bids, including buyer’s premiums, credit card fees, and sales tax. You agree to maintain valid credit card information in your account for as long as it remains active.
Town and Sea is not responsible for technical malfunctions on its partner site LiveAuctioneers.com. For issues using the LiveAuctioneers platform, please contact support@liveauctioneers.com.
All sales are final. Town and Sea is not responsible for internet bidding errors or electronic device malfunctions. Failure to pick up or pay for your items will result in forfeiture, with no refunds issued.
Buyer’s Premium
An 18% buyer’s premium will be added to the hammer price (winning bid) on all Town and Sea auctions held through LiveAuctioneers.
Sales Tax & Credit Card Fees
All sales are subject to applicable sales tax laws. Tax-exempt buyers must provide a valid state resale certificate prior to the sale. To be considered tax-exempt, your account name and billing address must match your certificate. Please email resale certificates to info@townandsea.com.
For LiveAuctioneers sales, exemption certificates must also be submitted to LiveAuctioneers.
By providing your credit card information, you authorize Town and Sea to charge your card for all purchases, including winning bids, buyer’s premiums, and taxes. All sales are final. Town and Sea is not responsible for internet bidding errors or electronic device malfunctions. Failure to pick up or pay for your items will result in forfeiture, with no refunds issued.
Refunds
All sales are final. Refunds will only be issued under the following circumstances:
- An item is lost prior to the pickup.
- An item is removed from sale by the seller.
- An item is damaged after photography but before the pickup.
Refunds, if applicable, must be agreed upon at the time of pickup or delivery. Once an item is released to a buyer or third-party shipper, the sale is considered complete and no further refunds will be given. Town and Sea is not responsible for damages occurring after release.
All refunds are subject to a 20% restocking fee.
Item Pickup
Consignment Purchases:
Items must be picked up within 14 days of purchase from our Stamford, CT warehouse (375 Fairfield Ave, Building 5). All pickups are by appointment. A storage fee of $10 per item per day will be charged for items not collected within this timeframe. For shipper recommendations, email logistics@townandsea.com.
Auction Purchases:
Winning bidders must pick up their items on the designated pickup date noted in the auction listing. Pickup location and times will be included in your invoice after the auction closes.
Buyers must bring appropriate packing materials, manpower, and transportation. If using a shipper, you must notify Town and Sea at logistics@townandsea.com with the shipper’s contact details in advance. Shippers must also pick up on the designated date.
Forfeiture of Items
Items not paid for or not picked up within the designated time frame will be considered forfeited.
If an item cannot be transported on the designated pickup day (for example, due to vehicle size), it will be considered forfeited if not removed during the scheduled pickup window. Town and Sea reserves the right to re-offer forfeited items for sale.
For consignment purchases, all items must be picked up within 14 days of purchase.
If additional time is needed, a formal request must be submitted in writing to logistics@townandsea.com before the 14-day deadline. Approval is at the discretion of Town and Sea and additional storage fees of $10 per item, per day may apply.
If no prior written request is made to logistics@townandsea.com before the 14-day post-sale window, the item will be deemed forfeited.
Intellectual Property
Unless otherwise stated, Town and Sea LLC and/or its licensors own the intellectual property rights for all materials on the website. You may not republish, sell, rent, sublicense, reproduce, duplicate, copy, or redistribute any content from Town and Sea without written permission.
